THIS DOCUMENT EXPRESSES THE TERMS OF USE ACCORDING TO WHICH YOU MAY USE COSMORANKINGS.COM. USING OUR SITE CONSTITUTES ACCEPTANCE OF THESE TERMS.

The following terms of use apply only to the use of, and purchases from, CosmoRankings.com. The terms 'you', 'your' and 'yours' refer to the user/customer utilizing our site to purchase products or services. The terms 'we', 'us' and 'our' refer to CosmoRankings.com. These terms do not apply to purchases made at our affiliate sites or in any other manner not utilizing the CosmoRankings.com website.

The content displayed on CosmoRankings.com, including, but not limited to, editorial content, information, pictures, artwork, illustrations and other graphical representations, as well as names, logos, trademarks, and service marks, are protected by copyright, trademark and all other intellectual property laws. By using CosmoRankings.com, you agree not to reproduce, retransmit, distribute, disseminate, sell, publish, circulate or otherwise broadcast any material, to any third party, without prior written consent of CosmoRankings.com.

Services

As permitted by law, CosmoRankings.com does not provide any warranties with regard to the information and applications contained on this site, and all services offered. In no event shall CosmoRankings.com, its contractors, agents, or employees be liable for any damages arising out of with the use or performance of CosmoRankings.com. This website, and the materials contained within this site, from time to time, may not be accessible due to power or server difficulties, site updates, or any other reason.

Errors on Our Site

Despite our efforts to ensure that the information on our website is accurate, complete and current, there may be instances when information about a product or service contains inaccurate or incomplete data, including data about the product's price or availability. We make no warranty or guarantee that the information on our website is error-free, complete, or current. We reserve the right to correct errors and/or update the content on our site at any time without notice. We also reserve the right to refuse or cancel any order containing any error or inaccuracy, including after the order has been submitted, whether or not the order has been confirmed and your credit card charged. If your order is canceled after your payment has been processed, we will issue a full refund to the original pay type.

Limitations and Exclusions

We reserve the right to change product pricing, terms, specifications and warranties without notice. In addition, we may revise these terms of use at any time by updating this website. We reserve the right to limit the number of products or services sold, including the right to delete services offered for sale on the site.

Special Terms for Website Traffic Packages

All orders are placed into the advertising rotation as soon as possible (usually within 24 to 72 Hours, depending on volume) following the date ordered. Orders placed on weekends will be filled on the next business day. Depending on the demand it may take longer than 72 hours for your campaign to start.

All traffic sent as "is". All campaigns are considered active the moment the first visitor (hits/traffic) is delivered to the client site. You are guaranteed that we will send the number of visitors to the URL you specify within 60 days or less of the campaign starting date. This is the only guarantee for this service. In no event shall we be liable for any consequential, direct, indirect, incidental, punitive, or other damages whatsoever (including, but not limited to, damages for loss of profits, loss of information or other pecuniary loss) arising out of the use or inability to use the package, even if we the service provider has been advised of the possibility of such damages. If we are unable to deliver the number of visitors promised within 60 days of the campaign starting date, you may claim a refund. In the unlikely event that we do not deliver the number of visitors promised, we will provide a refund of your entire purchase price on a pro-rata basis. In cases where refunds are claimed, we reserve the right to further investigate and approve or decline your request.

In the event that your website becomes unavailable for any reason (server is down or unavailable, timed out, or shows to be active but with internal server errors, 404 errors and other types of common or uncommon errors associated with the internet and its underlying infrastructure), you will not hold CosmoRankings.com or its partner sites responsible for these errors. All/Any traffic delivered to the your site during any downtime will not be credited or refunded. In the event that any of the above errors occur including any errors not listed but clearly intended, you may submit in writing a request for the campaign to be placed on hold. Upon resolution of the problem the held campaign will continue. Any traffic previously sent will not be credited or refunded.

We use a state of the art tracking system to track your ad campaign. Each order is given a unique campaign id which is used to track visitors to your site by day/time. When we provide an ad view, CosmoRankings.com points the visitors to this campaign id. The client understands that if the visitor viewing the ad closes it before it finishes loading (due to network bandwidth, high impact graphics, animation or lack of interest on the visitors part etc.), it will count as an ad view on our system, we have sent your site to the visitor and have therefore fulfilled our obligation. It is important to note that this scenario may not appear in your website statistics. CosmoRankings.com cannot control the acts of the individuals viewing your site and will not be held responsible for these actions.

When you purchase a campaign you understand and agree that the statistics system utilized by CosmoRankings.com will serve as the official record of traffic delivered. CosmoRankings.com will not be held responsible for traffic not received on your campaign page but sent from our ad server during downtime on any components on the Internet or on a clients site for any reason and any traffic delivered under these conditions will not be credited or refunded. CosmoRankings.com does NOT allow campaign pages with any kind of popup windows, exit windows or any other kind of extra generated window including system message windows and javascript alert windows, unless specified in the package description. Any additional window generated by your site shall be considered a popup window. You may NOT use any JavaScript to modify the window size. Your campaign page may not have any MUSIC/SOUNDS or JAVA APPLETS on the page we popup to. Attempting to use any JavaScript that change people's homepages or add your Web site to their favorites is prohibited. If a popup window is installed on the URL at any time, CosmoRankings.com WILL stop the campaign and you will NOT be entitled to a refund.

You understand that traffic counters on your site do not accurately represent the number of visitors sent to your site. This is due to the large amounts of traffic sent to the site in a relatively short timeframe. You also understand that CosmoRankings.com does not guarantee sales or signups and will not issue a refund if none are achieved. CosmoRankings.com does not guarantee sales, nor will we be held responsible if none are generated. We will send visitors to your site. That is the only guarantee for this service.

For country targeted traffic orders, we have an IP database and a script that works with the database to determine visitor's country and splits traffic into the country target. However, we cannot guarantee that the traffic will be 100% targeted for the specific country you requested. This is due to ISPs' use of dynamic IP addresses. You hereby agree that we are not responsible if you receive visitors other than from the requested country target. We will do our best to get you the most targeted traffic and this is the only guarantee for this service.
